AI Dangerous Output Governance Risk

The most dangerous AI output is not the obviously wrong answer. It's the answer that sounds intelligent enough to pass the meeting.


It is already happening.

In 2023, a New York lawyer submitted six fake legal case precedents to a federal court — all generated by ChatGPT. The cases did not exist. When confronted, ChatGPT continued to assert they were real.


In 2024, a $440,000 report submitted to the Australian government — written by Deloitte — contained fabricated academic sources and a fake quote from a federal court judgment.


That same year, Air Canada was ordered by a tribunal to honor a bereavement fare its AI chatbot had invented. The policy never existed. The airline tried to argue the chatbot was a "separate legal entity." The tribunal rejected this.


These are the cases that got caught.


Why does this happen?

AI does not retrieve facts. It predicts words.


When you ask an AI a question, it generates the response most statistically likely to follow — based on patterns in its training data. It has no internal fact-checker. It cannot distinguish what it knows from what it is fabricating. A completely invented answer gets delivered with the same tone, confidence and formatting as a verified one. Research from MIT found that AI models actually use more confident language — words like "definitely" and "certainly" — when generating incorrect information than when providing accurate responses.


This is not a bug being fixed. It is structural.


Inside organizations, the risk is compounding.

Executives, analysts and employees are using AI to summarize reports, analyze competitors, prepare briefing notes and draft recommendations. The output looks polished and credible. But consider what is already circulating:

  • Board packages with AI-generated competitor analysis containing fabricated market share data

  • Strategy documents citing industry research that does not exist

  • Executive summaries that subtly misread the original report

  • Recommendations built on assumptions no one verified


None of this requires bad intent. It requires misplaced trust — and organizations that have not built guardrails.


AI Risk Governance: Most Organizations Are Struggling

Vague awareness policies change nothing. Four things actually work:


1. Assign ownership. Name one person accountable for AI risk governance. Committees diffuse responsibility into inaction.


2. Mandate source documentation. Any AI-derived fact in a Board or executive document requires a cited, verified original source. No source, no inclusion.


3. Make AI disclosure non-negotiable. AI-assisted analysis must be flagged in executive packages — treated like a conflict of interest disclosure. This is the foundation of any credible AI governance strategy.


4. Define hard boundaries through Board oversight of AI. Boards need to identify which decisions AI cannot inform without expert sign-off — and hold management accountable for enforcing it. This is not an IT issue. It belongs in the boardroom.


Now — the honest AI governance problem.


Organizations like yours already know this is a risk. You probably knew it before reading this far. And most of us will do nothing differently on Monday morning.


That is exactly how AI fabrication comes back to bite - sometimes, hard!


It's not through ignorance. It's friction. The AI answer is right there. It sounds right. We're busy. The meeting is in twenty minutes. Verifying sources takes time nobody has. And nothing bad has happened yet — at least nothing you know about.


We need to internalize this fact: organizations that suffer most from AI hallucinations will not be the ones that didn't understand the risk. They will be the ones that understood it — and assumed it was either worth the risk or was somehow being handled.


That assumption - that it's somehow being handled - needs a name, an owner, and a deadline!


Without this governance formality, the likelihood of getting tripped up by an AI fabrication is a very high risk.
